It would be illegal to keep a dog in a tight space 23 hours a day and gas or Taser him for barking. It would be illegal to put a dog in deadly restraint for control. That happens to mentally ill people routinely in the nation's correctional facilities. What happened to Larry Neal? Why are we still asking that question after nearly 13 years, since August 1, 2003? Cover-ups regarding the wrongful deaths of mentally challenged inmates and free people in the USA are common and vile.

(1) Support the H.R. 2646 "Helping Families in Mental Health Crisis Act." The U.S. congressional bill provides for crisis intervention team (CIT) training for police and corrections officers, assisted outpatient treatment (AOT) programs (subsistence assistance plus mandated treatment) to stop recidivism, resumption of Medicaid insurance for certain facilities, and other needed changes. 
(2) Support "AIMI vs. USA" to compensate mentally ill people and their families for health discrimination.
(3) Support Bernie Sanders' bill H.R.3543 to end contracts with private prison companies.

Death Penalty Is Dying

The death penalty is dying, but it lingers in hospice. See an excerpt from an article by "Independent":

In 2015, only 28 people were executed here, the least in a quarter century (and one of them after a 36-year wait on death row). Moreover, all but four died in just three states: Texas, Georgia and Missouri.

Of the 50 US states, 34 haven’t executed anyone over the last five years, and soon South Carolina, another historical bastion of the death penalty, will join them.

Juries too are handing down far fewer death sentences, only 49 in 2015. Texas, long America’s chief executioner, was responsible for only two of them. For the first time in decades, the death row population has dropped below 3,000 – and only a relative handful of them will actually meet their end in the execution chamber.

Bipolar Execution Victim in Texas: Adam Ward

We are discussing capital punishment at my Facebook page. I am an anti-DP advocate and believe executions must end in the USA. This is particularly true for mentally ill Americans like Adam Ward, a 33-year-old bipolar man who Texas executed on Tuesday, March 22. The Huffington Post recently ran a story entitled "Bernie Sanders Speaks Out Against The Death Penalty After Hillary Clinton Stands By It." Senator Sanders said, "I believe it is time for the United States of America to join almost every other Western, industrialized country on Earth in saying NO to the death penalty."

When people enter controversial comments on my Facebook page and stalkers prevent their names from linking in my response, I feel that my response is censored. Sometimes I then enter said responses in an article in this "Justice Gagged" blog. I learned long ago that the hackers work for executioners, racists, and Nazis. The people, organizations, and topics I was writing to or about when I was most harshly censored may be surprising, including the NAACP, the national adult vaccination plan, Christianity, and Michelle Obama. Anti-dp language is always certain to be censored, which is why I usually run a separate digital camera when dealing with that subject online. My films will be made available to purchase for a nominal fee at CreateSpace. Americans should know which subjects are considered exempt from free speech protections by elitist Nazis.

Last Meals: The Phillip Workman Execution

Phillip Workman, number 4 on this list, was probably a wrongly ‪#‎executed‬ Tennessee man https://youtu.be/GgOkgZXKAHo >>Workman TRIED to rob a Wendy's but ran when police were called. He hid underneath a car and said he saw a ‪#‎police‬ officer shoot the policeman who was killed. Both of the officers were attempting to apprehend Workman. I was told by a former Shelby County Corrections Officer, Sgt. Early Story, that the murdered policeman was hated by his coworkers after he crossed a picket line and that he died within his first week back on the street after having been temporarily detailed to work inside the jail for his own safety. Workman's supporters for retrial included the victim's daughter, who felt that Workman was innocent after hearing recantations by witnesses who claimed they had been coerced to give false testimony against Workman.


The embedded video, which is also available at the YouTube link above, is called "12 Craziest Last Meal Requests," showing what condemned men ordered for their last supper. Workman ordered a pizza to be given to a homeless person, but his request was not honored. He refused a last meal.



Workman was convicted largely because Dr. O.C. Smith, the ‪#‎Memphis‬ Shelby County medical examiner at the time, claimed the bullet trajectory showed that ONLY WORKMAN could have shot the policeman. Dr. Smith apparently tried to retract his testimony immediately before Workman's execution by kidnapping himself and strapping dynamite to his person and wrapping barbed wire around his head. Dr. Smith secured notes to his person saying "The doctor lied about bullet trajectory in the Workman trial." Dr. Smith was also the medical examiner when Larry Neal was murdered under secret arrest in the Shelby County Jail in 2003. Neal was a lifelong mentally ill heart patient and my brother. >> Dr. Smith had a history of possibly lying to assist murderous police, according to the Workman case. The medical examiner's office failed to conduct any inquest or give any information about why and how Larry Neal, a mentally ill heart patient, was held for 18 days of SECRET ARREST and killed behind bars. 

Dr. Smith was prosecuted by the feds for allegedly strapping DYNAMITE to his own person and staging a false kidnapping. The case ended in a hung jury and was not retried. This reportedly angered some U.S. Attorneys. The Memphis Flyer reported: 

"After the Bureau of Alcohol, Tobacco and Firearms decided Smith was a suspect rather than a victim, he was indicted on federal charges. Terry Harris, who was then the U.S. attorney in Memphis, recused himself because the office had a professional relationship with the medical examiner. U.S. Attorney Bud Cummins of Little Rock came to Memphis to prosecute Smith. The trial ended in 2005 in a hung jury. Smith, who did not testify, was not retried." (Read more

Memphis authorities usually get a free pass, possibly because that is where civil rights icon Dr. Martin Luther King, Jr. was assassinated in a conspiracy. Larry Neal's kidnapping and murder in Memphis Shelby County Jail has been denied investigation and his family has been denied due process of law, including responses to Freedom of Information Act requests, for over 12 years. The death of this American with disabilities was denied exposure by censorship to protect killers and due to fraud by The Cochran Firm, the Neal family's wrongful death attorney. After Dr. Smith's antics, Workman won another hearing. Two ‪#‎Republican‬ judges came out of retirement to swing the vote against Workman in the hearing he was given after witnesses who recanted seemed to also include the State's star witness, the medical examiner. Workman was executed in 2007, and Dr. Smith is no longer the Shelby County medical examiner. I was told Dr. Smith then became an "expert witness" for America's corrupt courts. More wrongfully convicted people were exonerated in 2015 than in other years, including people on death row. The only way to stop wrongful executions is to eliminate the death penalty.

Kudos, Nebraska: No More DP

Nebraska abolitionists are to be congratulated, as are all people who place high value on humane solutions to crime and who advocate an end to America's barbarism. Nebraska became America's first conservative state to end capital punishment. We appreciate Nebraska's legislature for doing that. The Atlantic was one of many media companies that published the victory. A brief excerpt from The Atlantic is below:

Nebraska on Wednesday [May 27, 2015] became the first conservative state in more than four decades to repeal the death penalty. Its legislature, officially non-partisan but dominated by Republicans, voted by the narrowest of possible margins to override a veto by Governor Pete Ricketts, and enact a law scrapping a punishment that the state has struggled to carry out.

Most anti-dp organizations try to appeal to hardhearted people's sense of compassion. Newsflash: Elite white supremacists have no compassion; their god is money. It costs up to $90,000 more per year to warehouse each inmate on death row than to house him/her in the general prison population, according to the Death Penalty Information Center. Our Davis-MacPhail Truth Committee usually addresses the financial burden that executioners make taxpayers bear because they are money-hungry and bloodthirsty. If executioners were not so mercenary, death row inmates would be executed long before they are, 10 years to 30 years after sentencing. But prison investors keep condemned people alive on death row for decades, not out of compassion but to make more money. That is good news, because most people who were finally exonerated were imprisoned for a very long time. If condemned people were executed sooner, America would execute many more innocent people.

The Davis-MacPhail Truth Committee believes that abolitionists must make executions more expensive.  We advocate for LAWSUITS after each execution if any reason at all can be found to sue. Executions would get more media exposure by suing. Anti-DP organizations should sue after mentally ill people are executed. Sue after potentially innocent people are executed, especially if DNA tests were denied. Sue after guilty people are executed if the executions were torturous. Sue, sue, sue. Lawsuits mean significantly more to killers than candlelight vigils do. I believe the key to ending executions to to make them more expensive through lawsuits, just as speeders are deterred by traffic fines. Access the entire article at

ELIMINATING BLACK JURORS IN A GEORGIA MURDER TRIAL ~ "The rare grant of certiorari means the high court will examine in its next term a 1987 Floyd County murder trial. Timothy Tyrone Foster, a black man who was 18 years old when he was charged, was convicted of the murder of Queen White, an elderly, white, retired schoolteacher . . . The prosecution used its peremptory strikes against all four of the qualified prospective jurors who were black ..."

JUSTICE JOHN PAUL STEVENS SPEAKS AGAINST DEATH PENALTY ~ In a discussion at the George Washington University School of Law, retired Supreme Court Justice John Paul Stevens said the death penalty creates a higher risk of error than other criminal cases and is unfair, unnecessary, and a "terrible waste" of resources. Using the Boston marathon bomber trial as an example, Justice Stevens said jury selection procedures in capital cases produce juries who are "not representative of the community." He said that, under these procedures, "most of the 75%" of Bostonians who opposed the death penalty "could be challenged for cause and do not make it" onto the jury.

EXECUTING THE MENTALLY ILL
LONG BEFORE HE COMMITTED a vicious triple murder in Houston at the age of 19, Derrick Charles had shown signs of serious mental problems. Raised amid crippling poverty, domestic abuse, alcoholism and neglect, he watched his schizophrenic mother stab his abusive stepfather. He suffered from tactile and auditory hallucinations, and by the time he was 13, had been hospitalized twice for mental illness. While in juvenile prison for nonviolent offenses, he said he was hearing voices and asked for medication. The request was denied.

Nebraska May Repeal DP

 
Dear Mary,
Nebraska just moved one step closer to repealing the death penalty. Yesterday we asked for your help in contacting legislators in Nebraska to ask them to vote "YES" to LB 268 which would repeal the state's death penalty. I'm happy to report that you put the pressure on, and the Nebraska policymakers listened. They voted 32-15 to end the death penalty in Nebraska. We thank you!
We're not done yet though. Governor Pete Ricketts has vowed that he will veto this bill. We need all 32 legislators who voted to repeal the death penalty to hold their votes in order to override a governor veto.
Thank you for being part of the success. Thanks to your help, Nebraska could be the 19th state to abolish the death penalty.
